NOTICE OF PUBLIC HEARING – CONDITIONAL USE PERMIT AMENDMENT
STONECO-BURMEISTER GRAVEL PIT EXPANSION
Notice is hereby given that the Planning Commission will hold a public hearing on Tuesday, August 1, 2023 at 7:30 p.m. in the Freedom Township Hall (11508 Pleasant Lake Road) to invite public comment on an application from Stoneco of Michigan to amend the Conditional Use Permit approved in 2020 for the Stoneco-Burmeister Gravel Pit Expansion on parcels #N-14-26-300-007 & -014 (43.41 acres) on the north side of Bethel Church Road east of Schneider Road in the SW¼ of Section 26 and the A-R (Agricultural-Resource) zoning district.
The proposed amendment is to DELETE the following operational limitations from the approved Conditional Use Permit #2020-12-01:
- Without additional limitations on the proposed use designed to protect the public health, safety, and welfare, there is reasonable potential for noise, dust, and fumes from the proposed use (sand and gravel pit expansion) to have very serious consequences for use of surrounding property along Bethel Church Road, including impairing use of Bethel Church grounds for weddings, funerals, and other religious services.
Accordingly, this approval is subject to the following conditions determined by the Planning Commission to be necessary to protect the public welfare and to ensure that the proposed use will not interfere with or discourage the appropriate development and use of adjacent land and buildings or result in very serious consequences as defined in Section 205 of the Michigan Zoning Enabling Act, Public Act 110 of 2006, as amended:
(1) With the exception of perimeter berming and landscaping, no part of the proposed (sand and gravel pit expansion) shall extend closer than:
(a) 500.0 feet to the boundaries of the Bethel Church parcel N-14-35-200-004;
(b) 500.0 feet to the west boundary of parcel N-14-26-300-014; and
(c) 300.0 feet to the near edge of the Bethel Church Road right-of-way.
(2) No part of the perimeter berming or reclamation associated with the proposed (sand and gravel pit expansion) shall extend closer than:
(a) 400.0 feet to the boundaries of the Bethel Church parcel N-14-35-200-004;
(b) 400.0 feet to the west boundary of parcel N-14-26-300-014; and
(c) 200.0 feet to the near edge of the Bethel Church Road right-of-way.
(3) These setbacks are in addition to the applicable requirements of (the Township’s adopted Extraction) Ordinance No. 32.
